Preamble

The following terms & conditions apply to anyone visiting our website. We reserve the right to update them from time to time without notice and we therefore recommend to check them regularly.

Our RUBY helmets are ECE.22.05 approved and will satisfy the DOT standards if we take American customers’ orders and JIS Standards if we take Japanese customer orders.

The terms & conditions include the regulation of any transaction through this website and are agreed on by using this site or placing an order on the website of Ruby. The general terms & conditions are accepted and coming into effect without signature.

The purpose of our terms & conditions is amongst others, the definition of the contractual relationship between the visitor of the website or buyer, regardless of its legal entity, on the one hand and the owner of the website or seller on the other hand.

This site’s terms and conditions prevail over any other common terms & conditions if not expressively changed and confirmed in written form by Ruby, it applies to all clients having bought or buying a product from the present website.

Jurisdiction Clause

You, the client, irrevocably agrees that the courts of the People’s Republic of China shall have exclusive jurisdiction to hear, settle and/or determine any dispute, controversy or claim (including any non-contractual dispute, controversy or claim) arising out of or in connection with these terms and conditions, including any question regarding its existence, validity, formation or termination. For these purposes, each party irrevocably submits to the jurisdiction of the courts of the People’s Republic of China.

Pricing

The prices do not include duty & taxes and remain under responsibility of the buyer (the client).

The applicable price for any order is the price on the date of purchase through our website. Apart from that, the Ruby reserves the right to change its prices at any given time on the website.

Registration of an order

Once an order is issued on our website, we will process it internally and you will receive a confirmation about the incoming order from us by email. You can check the status of your order by contacting us at any time.

Payment terms

We accept all kinds of credit cards and debit cards. Payment is done at playing an order on our website. Please contact us, if you have issues paying with one of the offered payment options.

Delivery times and availability

Products that we have on stock, can be shipped out within one week although we rarely keep stocks ad most helmets’s production will start immediately once you have placed the order.

As a result of the large variety of color that we offer for our products, linked to the different sizing as a natural fact, the majority of helmets is made to order and the expected shipping time is extended by the lead time for production, which has a standard of about 6 weeks.

The products, even if not physically available on stock, are available for purchase as long as they are displayed on the website.

Cancellation

We reserve the right to refuse or cancel any order, irrespective of the reason for it and at any time of the order process without being held liable for any damage or costs. Please contact us if your order was canceled and you think it is without reason.

Shipping

Shipping charges apply according to the shipping costs stated during the checkout process.

The shipping address is the address, the buyer states during check-out on our website, unless expressively changed in written form on time before shipping has taken place and after our confirmation of the change of the shipping address by us.

The shipping carrier varies depending on the country of destination and its respective regulations or shipping options.

In case the carrier cannot deliver the shipment to its destination due to absence or unavailability of the buyer/receiver after at least two attempts, the shipment will automatically return to the sender. For any caused expenses as a consequence of the failed delivery attempts, including, but not limited to shipping costs, the buyer is fully held responsible and in case of another delivery attempt, has to cover the additional expenses before shipping takes place another time. Please follow the tracking information that we provide to avoid described situation.

Upon delivery, please inspect the delivery for damages and visual interference of the packaging. Do not accept the shipment if it is damaged and report to us instantly, so we can take measures for clarification. You are entitled to receive a replacement delivery or you will receive a full refund.

After accepting the shipment, please check the goods and notify us about any issue within two business weeks after receiving the shipment. Otherwise, the goods will be considered as accepted.

In the event of late delivery of your shipment or unusualness regarding the status of the shipment on the carrier’s tracking site, please contact us by stating the order number.

If eligible, we will request an investigation by the carrier to locate the shipment. This may take up to 4 weeks. If the shipment can be found, it will be redirected and delivered to the point of destination. If the shipment is declared finally lost after the investigation period, we will send you a replacement, i.e. a new product, or reimburse the payment. Neither refund nor shipment can be arranged before the end of the investigation period by the responsible carrier service.

Returns conditions

Depending on the order details and as mentioned above, we decide about the eligibility of a return. Should we accept to return a product, please note that the basic conditions are the following :

•    the products are neither used nor damaged in any way

•    the products are in their original package and complete as you received and accepted them.

Should the customer discovers after delivery that the helmet size is not fit, we are willing to help by exchanging the product with a new size, but we shall not proceed to any reimbursement or refund as each of our products is unique. The customer will have 10 days after delivery to request another size.

The customer carries any shipping costs that arise for the return. In case of return, we decrease the value to be reimbursed by the shipping costs for delivery to the buyer if not stated otherwise by us in each individual case. We will reimburse all shipment fees only, if the return is the result of a quality problem with the product delivered or a mistake from our side, such as e.g. wrong delivery. Please consider the effective period for notifying us about a quality issue within two business weeks after delivery. We will not take back defective goods after this period has been allowed to lapse.

Procedure

Contact us using the order number you have received from us.

Prepare the package as it was originally received, in flawless condition and clearly identify the item as a «return» on the return shipping documents and include the number we have provided to you.

Dispatch the package and make sure, that you receive a warranty for loss or damage. In case of loss or damage, we will not be able to reimburse the payment.

Reimbursements will be made within 30 days from the return of the item (arrival at our premises)

Guarantee

A helmet is a consumable product. Ruby guarantees the reliability of its products for a period of twelve months from the date of purchase (acceptance of the goods).

Please contact us if a product shows visible defects during the guarantee period.

The liability of Ruby is limited to the cost of repair or replacement of the item during this period.

The guarantee voids in the following cases:

•    The product is modified in any way and differs from the originally delivered product

•    The product has no identifiable serial number

•    Any deterioration, destruction or damage, that is not the result of defects in the process of manufacturing

Security and confidentiality

We will not, at any time, share your information with any third party, if not expressively consented by you as a result of an enquiry from our side.

Your personal data is used in the first place for the purpose of processing the order that was made through our system. After the order processing, we keep the respective information for our business records and for guarantee reasons.

We may contact you in future for any, from our perspective, important reason.

If you do not give your consent for any contact from our side at all, please tell us so in written form.
